GLORIOUS CIRCLE CONFERENCES OF NATIONAL UNIONS KARNATAKA CIRCLE



The 22nd circle combined Circle Conferences of NAPE, GROUP C,NUPE, POSTMEN &GROUPD& MTSAND NUGDS Started on 19th January 2014 at Sri Tirumala Kalyana Mantapam,Malur,Kolar District.
A mammoth Procession was taken in the main streets of Malur with the slogans of 7th CPC and other demands of CG employees ans Postal workers. The grand open session started in the afternoon of 19th with the invocation by Sri N.Srinath .Sri Chennakeshava, Chairman ,reception committee presided over the open session. Sri B.Sivakumar,Circle Secretary,NAPEC Welcomed the guests and invitees. Sri K.H.Muniappa, Honorable Minister of State for small scale Industries Govt of India inaugurated the open session by lighting the lamp. The General Secretaries of PIII,PIV ,GDS participated in the lighting ceremony. In his address the honorable minister praised the services of the Department of Posts and its employees to the public and the minister said it is the Disciplined Department. He assured his support to the Demands of the Postal Employees .Sri P.U.Muralidharan submitted memorandum to the Minister on the GDS issued to include them in the purviev of 7th CPC.Sri D.Kishan Rao General Secretary,NAPEC explained the Developments in the department  and sought for the support of the Minister for Post bank of India, DA merger and other Demands of CG employees.Sri T.N.Rahate,General secretary,PIV.Sri P.U.Muralidharan,GS NUGDS also addressed the mammoth gathering The otherprominent speakers were S.N.Raghunath,Secretary KPCC,Sri  Chennakeshava,  Chairman,reception Committee and leaders of public importance.

On 20th the subjects committtes of three unions started and in session

Two Days strike on 12th & 13th Feb'2014 - Action Programme

1)21.01.2014: Strike Notice will be served by General Secretaries to the Department at Dak Bhavan in New Delhi
2)28.01.2014. Conduct Dharna in front of Circle office/Regional office/ Divisional office. 
3)03.02.2014 to 08.02.2014, Campaign week, organize gate meetings, issue pamphlets etc.
 4)04.02.2014. Submit memorandum to the Circle Heads after conducting \  Lunch Hour Demonstration.
5)07.02.2014. Submit memorandum to Governor.
 6)Strike from 12.02.2014 to 13.02.2014.
                           Charter of Demands


1.      Accept the terms of reference of 7th CPC, submitted by the staff side, National Council JCM.
(a)      To examine the existing structure of pay, allowances and other benefits/facilities, retirement benefits like Pension, Gratuity, other terminal benefits of various categories of Central Government Employees including Gramin Dak Sevaks (GDS) of Postal Department.
(b)      To work out the comprehensive revised pay packet for the categories of Central Government employees including GDS as on 1.1.2014.
(c)       The Commission shall determine the pay structure, benefits, facilities, retirement benefits etc. taking into account the need to provide minimum wage with reference to the recommendation of the 15th Indian Labour Conference (1957) and the subsequent judicial pronouncement of the honorable Supreme Court there-on, as on 1.1.2014.
(d)      To determine the Interim Relief needed to be sanctioned immediately to the Central Government employees including GDS.
(e)       To determine the percentage of Dearness allowance/Dearness Relief immediately to be merged with Pay and pension including GDS.
(f)        To settle the anomalies raised in various fora of JCM.                                                     
(g)      To work out the improvements needed to the existing  retirement benefits, like pension, death cum retirement gratuity, family  pension and other terminal or recurring  benefits maintaining parity amongst past, present and future pensioners and family pensioners including those who entered service on or after 1.1.2004.
(h)      To recommend methods for providing cashless/hassle-free Medicare facilities to the employees and Pensioners including Postal pensioners.

2.      Ensure every five year revision of wages of Central Government Employees in future.
3.      (a) Regularization of Gramin Dak Sevaks of the Postal Department and grant of Civil Servant status, statutory pension and all other benefits at par with regular employees.
(b) Regularization and revision of wages of casual and contract workers.
4.      Compassionate appointment – removal of restrictions imposed by Government.
5.      JCM and Anomaly Committee Functioning.
6.      Fill up all vacant posts and creation of new posts wherever justified.
7.      Stop downsizing, outsourcing, contractorisation and privatization of Government functions.
8.      Stop the move to introduce performance related Pay (PRP) system, Extend PLB Bonus for all, removing bonus ceiling.
9.      Revise OTA and Night Duty Allowance rates and clothing rates.
10.  Implement arbitration awards.
11.  Five promotions to all.
12.  Rescind the PFRDA Act. Ensure statutory Pension for all.
13.  Settle MACP Anomalies.
14.  Stop trade Union victimization. Ensure Right to strike.
POSTAL DEMANDS.
1. Grand Recognition to GDS Union as per Sri.P.S.Natarajamurthy committee
        recommendation.
2.  Finalize cadre restructuring of Postal, RMS, C.O, SBCO, SystemAdministrator, ME and
       Civil&Electrical wing.
3.   Implement MMS cadre restructuring proposal

4.   Settle PO & RMS Accountants issue.

OFFICE MEMORANDUM
Subject:        Rule 32 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965- Advice of the Union Public Service Commission (UPSC) to be communicated to the delinquent Government servant along with the final order of penalty- Amendment - regarding
The undersigned is directed to refer to the provisions of the Rule 32 of the Central Civil Services (Classification, Control and Appeal) Rules, 1965 and to say that the nature of consultation with the Union Public Service Commission (UPSC) and the manner of communication of the advice of the UPSC to the delinquent Government servant have been subject matter of litigation in some cases in CAT/High Courts etc. The Hon'ble Supreme Court in the T. V. Patel case, delivered on 19.04.2007, held that the Disciplinary Authority is not required to furnish a copy of the advice tendered by the Union Public Service Commission to the Charged Officer before the final order of penalty is passed. Accordingly, vide Office Memorandum No. 11012/10/2007- Estt.(A) dated 07.01.2008, the Ministries/ Departments/ Offices were requested to comply with the existing provisions of CCS(CCA) Rules, 1965 and bring the contents of the O.M. to the notice of all concerned for adopting a uniform stand.
2. Now, the Hon'ble Supreme Court in its judgment on 16.03.2011, while dismissing the Civil Appeal No. 5341 of 2006 in the matter of Union of India & Ors. vs S. K. Kapoor, has held that it is a settled principle of natural justice that if any material is to be relied upon in departmental proceedings, a copy of the same must be supplied in advance to the charge sheeted employee so that he may have a chance to rebut the same. The Hon'ble Court also observed that there may be a case where the report of the Union Public Service Commission is not relied upon by the disciplinary authority and in that case it is certainly not necessary to supply a copy of the same to the concerned employee. However, if it is relied upon, then a copy of the same must be supplied in advance to the concerned employee, otherwise, there will be violation of the principles of natural justice.
3. The matter has been examined in consultation with Department of Legal Affairs and it has been decided that in compliance of the judgment of the Hon'ble Supreme Court in S.K. Kapoor case, a copy of the advice of UPSC, in all cases where the Commission is consulted, may be provided to the Charged Officer, not withstanding the provisions of Rule 17 and Rule 32 of CCS (CCA) Rules, 1965 before a final decision is taken by the Disciplinary Authority (DA).
4.         Accordingly. it has been decided that in all disciplinary cases where the Commission is to be consulted, the following procedure may be adopted:
 (i)        On receipt of the Inquiry Report, the DA may examine the same and forward it to the Commission with his observations;
( ii)       On receipt of the Commission's report, the DA will examine the same and forward the same to the Charged Officer along with the Inquiry Report and his tentative reasons for disagreement with the Inquiry Report and/or the advice of the UPSC;
(iii) The Charged Officer shall be required to submit, if he so desires, his written representation or submission to the Disciplinary Authority within fifteen days, irrespective of whether the Inquiry report/advice of UPSC is in his favour or not.
(iv) The Disciplinary Authority shall consider the representation of the Charged Officer and take further action as prescribed in sub-rules 2(A) to (4) of Rule 15 of CCS (CCA) Rules, 1965.
5.         A flow chart indicating the present and revised procedure is annexed for ready reference.
6.         All Ministries/ Departments/Offices are requested to bring the above guidelines to the notice of all Disciplinary Authorities under their control. All cases, where final orders have not been issued may be processed as per these guidelines.
7.         Formal amendment to CCS (CCA) Rules will follow.

OFFICE MEMORANDUM
Subject: Identification of jobs/posts for persons with Disabilities- review thereof.
The undersigned is directed to refer to this Department's OM No. 36035/3/2004-Estt.(Res) dated 29.12.2005 circulating consolidated instructions relating to Reservation for the Persons with Disabilities.
2. Ministry of Social Justice & Empowerment, in pursuance of the provisions of section 32 of Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Rules, 1995 had constituted an Expert Committee to review the identification of posts in all Groups in the Establishments of the Government of India and Public Sector Undertakings for persons with disabilities. On the recommendations of the Expert Committee, Ministry of Social Justice and Empowerment vide their Notification No. 16-15/2010- DD.III dated 29th July, 2013 has issued a amended list of identified posts in all Groups for persons with disabilities. A copy of this Notification, which is of more than 1500 pages, is available on the website of Social Justice and Empowerment.
3. Para 4 of this Department's OM No. 36035/3/2004-Estt.(Res) dated 29.12.2005 relating to identification of jobs/posts is amended accordingly and all the Ministries/Departments are now requested to utilize the list of identified posts specified in Annexure -C of the Ministry of Social Justice & Empowerment's Notification No. 16-15/2010-DD.111 dated 29.07.2013. It is further stated that the list of jobs/posts notified by the Ministry of Social Justice and Empowerment is illustrative and the concerned Ministries/Departments can further supplement the list to suit their job requirements.


4.          All the Ministries/Departments are also requested to bring the above instructions to the notice of all appointing authorities under their control.

OFFICE MEMORANDUM
Subject: Effective date of merger of erstwhile Group D posts, now designated as          Multi- tasking Staff in Pay Band-1 Grade Pay Rs.1800 and recruitment to the post after implementation of the recommendation of the 6th CPC.
In pursuance to the recommendations of the 6th Central Pay Commission, this Department has issued model recruitment rules for the post of Multi-tasking Staff (erstwhile Group D Posts) vide OM No. AB-14017/6/2009-Estt(RR) dated 30.4.2010. This Department is receiving references for clarification in regard to the date of effect of merger of erstwhile Group D posts and re-designation as Multi-tasking Staff.
2.       The issue has been examined taking into account this Department's OM No. 20020/4/2010-Estt(D) dated 30.4.2013 with regard to fixation of seniority of officers holding the merged grade of Multi-tasking Staff. It has been decided that the merger and re-designation of erstwhile Group D staff as Multi-taking Staff shall be effective from 29.8.2008. Ministries/ Departments may issue orders accordingly in respect of erstwhile Group D posts in their Ministries/ Departments and expedite the amendment of the Recruitment Rules of erstwhile Group D posts as the model RRs of MTS.
3.       Ministry of Home Affairs etc. are requested to bring the contents of this O.M. to the notice of all their Attached / Subordinate Offices. The autonomous/ statutory bodies may adopt the same with the approval of the competent authority as per the rules/ statutes.
